Terms of membership.

The Foundry is operated by Kieran Dowling, trading as Rose & Sword, a sole trader of 40 Buxton Court, London N1 7TN, United Kingdom. Contact: kieran@roseandsword.com.

By joining the Foundry you agree to these terms. Please read them before you pay.

1. What membership is

The Foundry is a men's group that meets online twice a month. Membership includes:

• The Foundry, the first Wednesday of each month — live teaching and practice, 19:30 UK time, fifty minutes with an optional further fifteen
• The Garden, the third Wednesday of each month — members only, same time
• Access to the library of previous sessions and their materials
• Access to the members' group between sessions
• Taking Your Measure, an in-depth questionnaire sent when you join

Members of the Foundry and the Anvil also receive one forty-five minute one-to-one session with me each month.

Sessions are held on Zoom. You will receive the link before each one.

2. Joining is by application

Payment is taken when you apply. Applying does not guarantee a place.

After you pay, I will send you Taking Your Measure. I read every one before confirming your place.

If I decide the Foundry is not right for you, I will tell you, refund your payment in full, and explain why. Where I can, I will point you towards something more appropriate. No further payment will be taken.

I reserve the right to decline any application without being required to justify the decision beyond the explanation I give you.

3. Price and payment

Prices are in pounds sterling and are charged monthly by recurring card payment through Stripe. I am not registered for VAT, so no VAT is added — the price shown is the total you pay.

• The Foundry — £65 per month standard, £50 per month founding
• The Foundry and the Anvil — £120 per month standard, £95 per month founding

Your first payment is taken on the day you join. Subsequent payments are taken on the same date each month. Where that date does not exist in a given month, payment is taken on the last day of that month.

Founding rates. A founding rate is held for as long as your membership runs without interruption. If you cancel and later rejoin, you rejoin at the rate applicable at that time.

Prices may change for new members at any time. If I change the price for existing members, you will get at least 30 days' notice in writing and may cancel before it takes effect.

4. Minimum term

Membership has a minimum term of three months. By joining you commit to three monthly payments.

After the third payment, membership continues month to month until you cancel.

5. Cancelling

To cancel, write to kieran@roseandsword.com. There is no cancellation button — I would rather you told me.

Cancellation takes effect at the end of your current paid month. You keep access until then. Part-months are not refunded.

Cancelling before the end of the three-month minimum does not release you from the remaining payments in that term, except where section 2 or section 6 applies, or where I agree otherwise. If your circumstances change materially, write to me. I would rather sort something out than hold you to a payment you cannot make.

6. Your right to change your mind

You have fourteen days from joining to cancel and receive a full refund, whether or not you have attended a session.

After fourteen days, refunds are at my discretion, except where required by law.

If I cancel your membership under section 8, or if I stop running the Foundry, you will be refunded for any period paid for and not delivered.

7. If a payment fails

If a payment fails, Stripe will retry it and you will be notified. If it has not succeeded after 14 days your access may be suspended until it is resolved.

A failed payment does not cancel your membership or your minimum term. Write to me if there is a problem.

8. Conduct, and removal

The Foundry only works if the room is safe to speak in. I expect members to be straight with each other, to let other men finish, and to keep what is said in the room in the room.

What is said in the Garden is confidential. Do not repeat it, write about it, or discuss it outside the group, including with a partner. This holds after your membership ends.

I may remove a member, without refund of the current month, for: breaching confidentiality; abusive, threatening or discriminatory behaviour; recording a session; or sharing members-only material outside the group.

Where a removal is for something less serious, I will speak to you first.

9. Recordings and materials

The Foundry sessions are recorded and kept in the library.

The Garden is never recorded. No recording of the Garden exists, and none will.

Members may not record any session themselves.

All teaching materials, recordings, slides, protocols and written material remain my property. They are for your personal use as a member. Do not share, republish, resell or distribute them.

Access to the library ends when your membership ends. Anything you downloaded while a member is yours to keep for your own use.

10. This is not therapy or medical care

The Foundry is education and group practice. It is not therapy, counselling, psychiatric treatment, or medical care, and I am not a doctor, therapist or psychologist.

Nothing said in a session, in the library, in the members' group, or in a one-to-one is medical advice. Do not use it to diagnose or treat anything, and do not use it in place of seeing a professional.

Before starting any physical practice taught here, satisfy yourself that it is safe for you. If you have any injury, condition, or concern — or if you are unsure — speak to a doctor or a qualified professional first. Some of the work is physical. You take part at your own risk and you are responsible for your own body. Stop if something hurts.

If you are in crisis, or if something in your life needs clinical help, please get that help. A men's group is not a substitute for it, and I would rather point you somewhere useful than have you rely on this.

I make no promise about the results you will get. What you get out depends on what you put in and on circumstances neither of us controls.

11. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

Subject to that, my total liability to you is limited to the amount you have paid in the twelve months before the claim.

I am not liable for indirect or consequential loss.

12. Things outside my control

If a session cannot run — illness, technical failure, or anything else outside my reasonable control — it will be rescheduled or the recording made available where possible. An occasional rescheduled session does not entitle you to a refund. If I cancel repeatedly and stop delivering what you are paying for, section 6 applies.

13. Your data

I hold your name, email address, payment record and your answers to Taking Your Measure.

Your answers to Taking Your Measure are read by me and nobody else. They are not shared, sold, or used for anything other than your membership.

Card details are handled by Stripe and never reach me.

You can ask me to delete your data at any time after your membership ends. Full detail is in the privacy notice.

14. Changes to these terms

I may update these terms. Material changes will be notified by email at least 30 days before they take effect, and you may cancel before then.

15. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.

Nothing here affects your statutory rights as a consumer.
